On 16 December, the Court of Appeal found that the detention of asylum seekers who are not at risk of absconding whilst their appeals are pending is unlawful. It upheld Detention Action’s appeal on the grounds that the policy on detaining asylum seekers during their appeals is not sufficiently clear and transparent.
